SECTION 02

Terms of Service

In Simple Terms

  • 1 We agree on scope before starting. Every project gets a clear proposal with deliverables, timeline, and pricing — no surprises.
  • 2 You own your project. Once payment is complete, all designs, code, and assets are yours. No recurring fees or hidden royalties.
  • 3 Revisions are included. We offer revision rounds as specified in your project proposal. Additional revisions are quoted transparently.
  • 4 We respect deadlines. Both parties commit to agreed timelines. We provide regular progress updates so there are never surprises.

Full Terms of Service

2.1 Agreement. These Terms of Service ("Terms") govern all creative services provided by CreativeFlowSystems, registered at 1 Rue Saulnier, 75009 Paris, France ("Provider", "we", "us"), to the client ("Client", "you") as specified in individual project proposals and Statements of Work.

2.2 Scope of Work. All services are defined in a written project proposal or Statement of Work (SOW) signed by both parties. Any work outside the agreed scope requires a separate written amendment with adjusted pricing and timeline.

2.3 Payment Terms. Invoices are payable within 14 days of issue unless otherwise specified in the SOW. A 50% deposit is required before project commencement. Remaining balances are due upon delivery of final assets. Late payments incur a 1.5% monthly interest charge.

2.4 Intellectual Property. Upon complete payment of all invoices, the Provider assigns all worldwide intellectual property rights in the client-specific deliverables (designs, code, content, and assets) to the Client. The Provider retains the right to display completed work in portfolios and case studies unless otherwise agreed in writing.

2.5 Revisions. Each project proposal specifies the number of included revision rounds. Additional revision rounds beyond the agreed scope are billed at €85/hour. Revisions must be submitted in writing within 14 days of deliverable presentation.

2.6 Project Timeline. Timelines specified in the SOW are estimates. The Provider commits to best-effort delivery within agreed timeframes. Delays caused by the Client (late feedback, missing content, delayed approvals) will extend the project timeline proportionally.

2.7 Limitation of Liability. The Provider's total liability under any contract shall not exceed the total contract value paid by the Client. The Provider is not liable for indirect, consequential, or incidental damages including lost profits, data loss, or business interruption.

2.8 Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the project. This obligation survives the termination of the agreement for a period of 24 months.

2.9 Termination. Either party may terminate the agreement with 14 days written notice. Upon termination, the Client pays for all work completed to date. The Provider delivers all completed work products upon receipt of final payment.

2.10 Governing Law. These Terms are governed by French law. Any disputes shall be resolved first through mediation, then through the competent courts of Paris, France.

Refund & Reimbursement Policy

In Simple Terms

  • 1 14-day cooling-off period. If you cancel within 14 days of signing, you receive a full refund of your deposit — no questions asked.
  • 2 Partial refunds for incomplete work. If we haven't started, full refund. If we've partially completed, you pay for work done and get the rest back.
  • 3 We're committed to getting it right. If you're unsatisfied with deliverables, we'll work with you to make it right before any refund discussion.

Full Refund Policy

4.1 Cooling-Off Period. In accordance with EU consumer protection law (Directive 2011/83/EU), the Client has a 14-day cooling-off period from the date of contract execution to withdraw from the agreement and receive a full refund of any deposits paid, without providing justification.

4.2 Cancellation After Cooling-Off. After the 14-day cooling-off period: (a) If no work has commenced, a full refund of the deposit is issued within 14 business days; (b) If work has partially commenced, the Client is invoiced for work completed to date at the agreed hourly or project rate, and any excess deposit is refunded within 14 business days; (c) If work is substantially complete (80%+ of deliverables), no refund is issued and the remaining balance is due.

4.3 Deliverable Dissatisfaction. If the Client is dissatisfied with delivered work products, the Provider shall first offer reasonable revisions within the agreed scope to address specific concerns. Refund requests will only be considered after the revision process has been exhausted.

4.4 Non-Refundable Items. The following are non-refundable: (a) Third-party costs incurred on behalf of the Client (stock licenses, domain purchases, hosting fees); (b) Work completed and approved in writing by the Client; (c) Additional revision work beyond the agreed scope.

4.5 Refund Process. Refund requests must be submitted in writing to [email protected] with the subject line "Refund Request — [Project Name]". Refunds are processed within 14 business days via the original payment method.

4.6 Dispute Resolution. Refund disputes shall first be addressed through direct negotiation between the parties. If no resolution is reached within 30 days, either party may refer the matter to mediation through the Centre de Médiation et d'Arbitrage de Paris (CMAP).
